The family of an Amarillo school student is suing th e school district after an allergic reaction happened on school property.

A parent and grandmother of 11-year-old Emerson Cole, a Lorenzo de Zavala Middle School student, is suing the Amarillo Independent Schools in 108th District for alleged negligence.

Cole died in January of 2023.

The lawsuit states that Cole was diagnosed with a severe dairy allergy, and an action plan was in place as to what actions the school should take in the event of an allergic reaction.

The lawsuit also states that Cole’s condition qualified her as an individual with a disability under the Americans with Disabilities Act.

It also goes on to say, the timeline of events that led to Cole’s death on Jan. 19, 2023, beginning with the initial allergic reaction on campus on Jan. 17.
